Modification of Child Support and Child Custody Orders

Motions to modify child custody or child support often involve a threshold legal issue that the family law attorney must carefully analyze before filing, or undertaking to defend, a modification case. Under Missouri law, a child support or child custody order can be modified if there has been a substantial and continuing change in circumstances that makes the original order unreasonable.  Experience with similar cases and close familiarity with evidence law are often critical to determining whether this standard is likely to be met in a particular case.  There are various ways in which circumstances can change to make the original order unreasonable.

In child support cases there is usually, though not always, a substantial and continuing change if there is a 20% difference between the child support order versus the amount the obligor would have to pay in light of changes in the parties' finances since the order.

A continuing change of circumstances allowing the court to modify a prior visitation or custody decree can occur when a parent or child moves, when there is a change in living situation, or when a child's educational or relational needs change, among other things.
